Terms and Conditions of Peninsula Perfect Companion

Peninsula Perfect Companion is a regional program (“the Program”) of The Peninsula Hotels (“the Group” or “We” or us), applicable to Peninsula Hotels within the People’s Republic of China (“China”), including: The Peninsula Hong Kong (operated by: The Peninsula Hotel Limited), The Peninsula Shanghai (operated by: The Peninsula Hotel Shanghai Bund Limited), The Peninsula Beijing (operated by: The Palace Hotel Co., Ltd.), and the Group's other businesses in China. Users who have joined the Program (“Peninsula Perfect Companion” or “You”) are entitled to the benefits according to local terms and conditions.

 

1. Applying for Peninsula Perfect Companion

 

1.1 This Program is open to the public free of charge, and individuals who are 18 years old and above can apply for it.

1.2 The applicant shall provide the required personal information and agree to relevant terms and conditions before joining in the Program. To make an application, an applicant shall provide us via the WeChat Mini Program (“Mini Program”) of Peninsula Perfect Companion or authorize us to obtain through WeChat platform the personal information such as the applicant's WeChat ID, region, mobile phone number and etc., so that we can verify the identity of the applicant.

1.3 We respect personal privacy of each customer and will send news, information, offers and, benefits related to this Program only to the Peninsula Perfect Companion users who agree to receive our messages. If you refuse us to send any message to you during the application, you will not get our discounts and benefits.

1.4 The Group has the right to agree or refuse to grant the Peninsula Perfect Companion qualification. 

2. Services Available

2.1 We will provide you with services through the Peninsula Perfect Companion Mini Program in accordance with these Terms and Conditions. If there is any conflict or inconsistency between these Terms and Conditions and the terms and conditions of the Group, these Terms and Conditions shall prevail.

2.2 Each WeChat account and its corresponding phone number can be used to register only one Peninsula Perfect Companion account, and each Peninsula Perfect Companion user can only have one account. If you inadvertently set up another same account, we will have the right to include the relevant information in your earliest account. This may affect some of your offers and rewards.

2.3  We reserve the right to suspend or terminate any service at our sole discretion at any time without prior notice.

2.4  If the Group reasonably believes that you have violated these Terms and Conditions or have exchanged or obtained the offers or rewards in this Program in a dishonest manner, we shall be entitled to take back relevant offers or rewards and cancel your Peninsula Perfect Companion qualification.

3. Offers and Rewards

3.1 All offers and rewards under this Program are available the users of Peninsula Perfect Companion themselves and shall not be transferred to or used by others.

3.2 Unless otherwise stated specifically, a user must present and successfully scan the valid QR code in the Mini Program before his/her offers or rewards could be used.

3.3 Instructions for using offers and rewards:

(a)  The upgrade of housing and room needs to be confirmed depending on the check-in

(b)  All housing, dining and SPA offers are subject to advance reservation;

(c)  The offer cannot be combined with other promotions, and blackout dates may apply;

(d)  All offers cannot be exchanged for cash or other items;

(e)  Some offers or rewards are redeemed on a FCFS basis while stocks last or may be replaced with other offers without any prior notice;

(f)  Peninsula Perfect Companion users can apply to issue invoices or receipts according to the actual consumption amount; 

3.4 Any offer details are subject to final information of the participating hotels, restaurants, SPAs and stores. To avoid any inconvenience, please feel free to consult with relevant hotels, restaurants, SPAs and stores if you have any question.

4. Transfer, Cancellation and Termination

4.1  The Peninsula Perfect Companion qualification cannot be transferred or inherited.

4.2  You may delete your account in the Mini Program and cancel or terminate the registration of this Program at any time. Once an account is deleted, the deletion will take effect immediately. Your account and all of your personal information kept before deletion will be deleted from the system immediately. The deleted account cannot be retrieved or restored.

4.3 After the deletion, you will no longer be able to log in and use the Mini Program with the deleted account. All reserved offers and rewards will also expire immediately. 

5. Personal Information

5.1 You agree that all personal information about you can be used or disclosed and transferred within the Group for purposes related to this Program, or to other parties (including but not limited to card-issuing banks and data processors) at any time according to the personal information (privacy) guidelines of the Group and other laws, rules, regulations and guidelines applicable from time to time.

5.2  To offer you more considerate and personalized services, we might need you to provide other necessary information. Before obtaining this information, we will ask for your prior consent; you have the right to refuse, which may make some services and/or benefits unavailable. 

6. Group's Responsibilities

6.1 We will assume no responsibility or obligation for the consequences caused to you or any third party arising from or in connection with the following:

  1. The interruption, suspension, delaying, missing, or other failures whatsoever caused during the transmission of your instructions or other messages;
  2. The Mini Program cannot provide the services under this Program (including but not limited to the loss of data information, failure to log in or use, etc.);
  3. Any failure, interruption or insufficiency of equipment or devices related to the performance of the Group’s functions hereunder, as well as the force majeure or any other cause beyond reasonable control of the Group.

6.2 However, it does not fall within the scope of Section 6.1 if the circumstances above are caused due to the negligence or deliberate breach on the part of the hotels or their managers or employees.

7. Applicable Law and Jurisdiction

7.1 These Terms and Conditions and any dispute arising from or related thereto, including non-contractual dispute or claim, (“Dispute”) shall, in principle, be governed by and interpreted according to the law of the jurisdiction where the relevant entity is located, with specific rules set forth in Section 7.2 hereof. 

7.2 The Group and each Peninsula Perfect Companion user agree that any Dispute:

  1. shall be subject to the exclusive jurisdiction of the laws of Mainland China and the competent courts where the hotels are located, if only the Peninsula Shanghai and/or the Peninsula Beijing are involved.
  2. shall be subject to the exclusive jurisdiction of the laws of Hong Kong Special Administrative Region of China (“Hong Kong”) and its courts, if other entities in addition to the Peninsula Shanghai or The Peninsula Beijing are involved (whether one of both of these two hotels are involved ).

8. Severability

Each of these Terms and Conditions are separate and severable. If one or more terms are held to be illegal, invalid, or unenforceable in any respect under the laws of any jurisdiction at any time, the legality, validity or enforceability of other clauses in these Terms and Conditions shall not be affected in any way.

9. Miscellaneous

The Group may change these Terms and Conditions from time to time based on the needs of the Program and will post these changes in a timely manner.
